Berlin's rental market has a sharper enforcement signal after the first automated Mietenscan found possible rent-control issues in 2,102 assessed June listings.

The Scan Changes Listing Risk

The first review captured 7,757 June advertisements and assessed 4,539 after excluding duplicates and cases outside the relevant comparison base. About 46 percent of assessed listings were flagged for possible breaches of rent limitation rules.

Mietspiegel 2026 Is The Benchmark

Berlin's qualified 2026 rent index is now the reference point for checking whether a new letting sits more than 10 percent above the local comparative rent unless an exemption applies. That moves compliance from a lease-file issue into public listing strategy.

Investors Must Underwrite Legal Income

A rental building cannot be valued only on hoped-for reletting rents. Furnishing claims, modernisation records, new-build exemptions and prior leases all affect whether advertised income can actually be collected.

Buyer Checks

Investors should review rent rolls, Mietspiegel classification, lease history, modernisation notices, furnished status and any authority correspondence. Tenants should compare listing rents with the official reference category before signing, especially where a flat is marketed as furnished or recently upgraded.

Outlook

Berlin's shortage still supports occupancy, but automated scrutiny reduces room for aggressive assumptions. Buildings with documented legal income should trade better than assets priced on unenforceable rent growth.
