These Terms of Use (“Terms”) govern your use of housingmarketgroup.com and the other websites operated by Housing Market (Thailand) Co., Ltd. (“Housing Market Group”, “we”, “us” or “our”), together the “Websites”. By using the Websites you agree to these Terms. If you do not agree, please do not use the Websites.

Some of our products have their own terms, for example Housing Market Ads. Where a product has its own terms, those terms apply to that product in addition to these Terms, and they take precedence if the two conflict.

1. Use of the Websites

You may use the Websites only for lawful purposes. You must not:

• use the Websites in a way that breaks any law or regulation
• try to gain unauthorised access to the Websites, their servers or any connected system
• interfere with or disrupt the Websites, including by introducing viruses or other malicious code
• copy, scrape or collect content or data from the Websites by automated means without our written permission
• use the Websites to send unsolicited advertising or to impersonate any person or organisation

2. Accounts

Some services require an account. You are responsible for keeping your login details confidential, for all activity under your account, and for keeping your account information accurate. Tell us promptly if you believe your account has been used without your permission. We may suspend or disable an account that breaks these Terms.

3. Listings and other content you provide

If you publish property listings, photographs, descriptions, prices or any other content through our services, you are responsible for that content. You confirm that it is accurate, that you have the right to publish it, and that it does not infringe anyone else’s rights or break any law.

You grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content for the purpose of operating and promoting our services. Listing information comes from the agents, owners and other users who publish it. We are not a party to any transaction between buyers, sellers, landlords, tenants or agents. We may remove or disable content that we reasonably believe breaks these Terms or the law.

4. Intellectual property

Apart from content provided by users, the Websites and their content, including text, graphics, logos, software and videos, are owned by or licensed to us and are protected by intellectual property laws. Housing Market Group and the names and logos of our products are our trademarks. You may view and print pages for your own personal, non-commercial use. Any other use requires our prior written permission.

5. Third-party services, including YouTube

The Websites link to, and embed, services provided by third parties, such as videos, maps and payment services. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

Some pages show videos hosted on YouTube, and we use YouTube API Services to publish our own videos to our YouTube channel. By watching YouTube content on or through the Websites, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). 6. Disclaimers

The Websites and their content are provided “as is” and “as available”. We do not guarantee that the Websites or their content are accurate, complete, up to date, uninterrupted or free of errors or viruses. Make your own enquiries before relying on any information, including before buying, selling or renting a property.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or business opportunity, arising from your use of, or inability to use, the Websites or any content on them. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

We may update these Terms from time to time. The date at the top of this page shows when they were last changed. If you continue to use the Websites after a change, you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of Florida and of the United States. Any dispute arising from these Terms or from your use of the Websites is subject to the jurisdiction of the courts in Tampa, Hillsborough County, Florida.
