Karnataka Redevelopment Rule Changes Bengaluru Society Valuations
Bengaluru apartment buyers now have a new legal variable after Karnataka passed a framework for common areas, associations and redevelopment.
Bill Passed
The Karnataka Apartment Ownership and Management Bill passed the Legislative Assembly in late August. Local reporting highlighted clearer rules for residents' welfare associations, transfer and management of common areas, dispute resolution and redevelopment of ageing apartment complexes.
Consent And Compensation
A key provision allows reconstruction where 75 percent of apartment owners approve. Dissenting owners are to receive compensation through an independent valuation mechanism, with reports describing payment equal to twice the assessed value before acquisition for reconstruction.
Bengaluru Impact
Whitefield, Indiranagar, Koramangala, Hebbal and older central apartment clusters will feel the change differently. Buildings on valuable land may now trade partly on redevelopment optionality, while newer societies should gain from cleaner common-area records and formal management duties. Societies with missing handover files may have to spend time regularising documents before buyers price the redevelopment upside.
Document Checks
Purchasers should review association registration, undivided land share, common-area schedule, occupation certificate, RERA status, maintenance arrears, litigation, redevelopment minutes, structural certificates and builder handover documents. A high land value is weak if records are disorganised.
Outlook
Implementation will decide whether the law improves confidence or creates new disputes. Bengaluru societies with complete records should command better buyer trust.
